Hong Kong establishes rules to enable crypto staking

Hong Kong regulator, the Securities and Futures Commission (SFC), has established guidelines for crypto staking service providers.

 

That’s according to a statement published by the SFC to its website on April 7. The guidance is aimed at licensed virtual asset trading platforms (VATPs) and SFC-authorized funds with exposure to digital assets.

Expanding service offering

The regulator points out that the guidance on staking falls in line with its recently announced “ASPIRe” roadmap, which is geared towards ensuring that the Chinese autonomous territory remains relevant in its efforts to maintain its status as a global hub for crypto businesses.

 

Expanding product and service offerings within the crypto sector was one of the five pillars of that plan. Smoothing the way for the offering of staking works towards fulfilling that aspect of the ASPIRe plan.

 

Written approval

In this guidance, the SFC sets out that licensed service providers must obtain written approval from the regulator before any such product can be offered to investors in Hong Kong. That stipulation applies to both VATPs and authorized funds with digital asset exposure. 

Additionally, VATPs must retain control over staked assets, with no delegation in the custody of such assets to third parties permitted. In the case of authorized funds that include crypto assets, they must stake virtual asset holdings through licensed VATPs and other authorized institutions.

 

Required disclosures

The regulator has also stipulated that certain disclosures must be made by licensed exchanges to potential customers in respect of staking products. These include the disclosure of all associated risks, full transparency with regard to fees, minimum lock-up periods and custodial arrangements.

 

Commenting on the provision of this guidance, SFC CEO Julia Leung said that the provision of a greater range of regulated services and products is crucial in order to sustain continued growth of Hong Kong’s virtual asset ecosystem. However, she added that any broadening of the range of services offered “must be done in a regulated environment where the safety of client virtual assets continues to be front and centre of the compliance framework for offering such service.”  

 

The SFC outlined that it recognizes “the potential benefits of staking in enhancing the security of blockchain networks and allowing investors to earn yields on virtual assets within a regulated market environment.”

 

The authorities in Hong Kong are not the only ones who recognize the benefits that the incorporation of staking within crypto investment products can bring. Last month, Robert Mitchnick, head of digital assets at the world’s largest asset manager, BlackRock, told the Digital Assets Summit in New York that Ether ETFs would benefit from the addition of staking. 

 

Mitchnick suggested that the current inability to earn a staking yield within such products is a key limitation. He outlined that such a change is dependent upon relevant regulatory changes being implemented in the U.S. A more crypto-friendly climate in the U.S. since U.S. President Donald Trump took office has resulted in various lawsuits being dropped against companies like Coinbase related to the staking services that had been offered.

 

A number of U.S. Ether ETF issuers, including Franklin Templeton, Grayscale and Bitwise, have put forward proposals to the Securities and Exchange Commission (SEC) to have staking included in these products.

ACE Exchange in turmoil as Taiwanese prosecutors broaden investigation

Taiwanese prosecutors have expanded their inquiry into ACE Exchange, urging the detention of Chenhuan Wang, the platform's president and partner at Chien Yeh Law Offices. The Taipei District Prosecutors Office disclosed to The Block that Wang, alongside four other suspects, was summoned after police raids in Northern Taiwan earlier this month. Subsequent to the interrogation, prosecutors sought Wang's detention and restrictions on visitation rights, alleging his involvement in money laundering and fraud linked to the activities orchestrated by the detained founder, David Pan. Chien Yeh Law Offices has moved to distance itself from its partner’s activities, stating that the matter is a personal investment of Wang’s. It stated:”Ace Digital Innovation Co., Ltd. is the personal external investment affairs of lawyer Wang Chenhuan and has nothing to do with the firm.”Photo by Thomas Tucker on UnsplashMisleading advertisingPan, along with colleague Lin Nan, is accused of a three-year collaboration, utilizing misleading social media advertisements to deceive investors into acquiring worthless cryptocurrencies, including MOCT. The inclusion of Wang in the investigation now requires a court determination on potential detention. ACE Exchange responded to Pan's arrest earlier, asserting that Pan had ceased daily operations in 2022, with Wang assuming the presidency in September 2023. Wang claimed to have initiated efforts to delist controversial coins, with ACE assuring cooperation with investigations as a witness. The exchange affirmed the normalcy of trading and operational conditions, emphasizing the security of user assets and smooth cryptocurrency and New Taiwan dollar deposit and withdrawal services. Established in 2018, ACE Exchange ranks among Taiwan's prominent crypto exchanges, alongside BitoGroup and MaiCoin. In spite of alleged wrongdoing relative to key actors within the business, the platform has outlined its commitment to legal principles, stating zero tolerance for any misconduct within its management team. Regulatory focus on offshore exchangesIn the broader context of Taiwan's crypto landscape, the Financial Supervisory Commission (FSC) plans to impose restrictions on offshore cryptocurrency exchanges operating within its jurisdiction, unless they secure required registration. In September last year, the FSC drafted guiding principles for virtual asset service providers (VASPs). These guidelines aim to fortify information disclosure, set review standards for virtual asset listing and delisting and ensure the secure separation of companies' and customers' assets. The FSC intends to strictly prohibit illegal business solicitation by foreign crypto firms, mandating registration and compliance declarations with anti-money laundering regulations. Failure to comply will result in the prohibition of business solicitation within Taiwan or from domestic residents by foreign VASPs. As Taiwanese prosecutors intensify their efforts, the ACE Exchange case unfolds as a critical episode in the evolving regulatory landscape, prompting both legal scrutiny and a reevaluation of the country's approach to crypto oversight.

Coinbase Ventures, the investment arm of US cryptocurrency exchange Coinbase, focuses its attention on early-stage cryptocurrency and blockchain projects.That’s precisely why it has now participated in a $10 million investment in the Singaporean start-up, given that the ZkLink network doesn’t launch on mainnet for a number of months yet. Other participants in the funding round included Ascensive Assets, SIG DTI, BigBrain Holdings, Efficient Frontier, among others.In posting news of the funding to social media, ZkLink confirmed that the fresh strategic funding round has brought total funding to date to $18.5 million. “The funds raised take zkLink a step further to envision a multi-chain future with unified liquidity and seamless multi-chain user experience while remaining fully trustless and self-custodial,” the project stated.Its previous $8.5 million funding round was completed in October 2021. Among the early investors on that occasion were Arrington Capital, DeFi Alliance, Huobi Ventures, Ascensive Assets, Morningstar Ventures, GSR, Marshland Capital, Skynet Trading, ZBS Capital, and others. New York-based blockchain financing and investment platform, Republic Crypto, was the lead investor at that time.Bridging assets securely acrossZkLink uses zero knowledge technology in order to connect various layer one and layer two networks. A zero knowledge proof is the core innovation that the approach relies upon, with the proof presenting as a cryptographic technique that ensures that no data is revealed during a transaction, save for the exchange of some known value already evident to both prover and verifier.That approach makes for efficient cross-chain bridging, guaranteeing strong security without external trust assumptions. By connecting various layer one and layer two networks, zkLink claims that it empowers the next generation of decentralized trading products.Developers can access ZkLink application programming interfaces (APIs) in order to create order book decentralized exchanges (DEXs), NFT marketplaces, among other use cases. The project is harnessing zero knowledge technology to abstract away all the complexity of multi-chain trading while keeping it ultra secure and true to the ethos of crypto.A multi-chain futureWith blockchain networks being highly fragmented, the concept of a multi-chain future is one that is being increasingly embraced within the crypto space. Various projects have been launched in an effort to effect such a scenario. However, the first generation of bridging solutions have proven to be weak from a security perspective. Zero knowledge technology is seen as a potential solution to this issue.Effecting a seamless multi-chain will also bring about greater efficiencies. As a case in point, currently USDT-Ethereum and USDT-Solana exist as separate assets on distinct blockchains representing the very same USDT stablecoin. With seamless bridging, there would be no need for the duplication.In recent days, the ZkLink project team has been busy working on safety features related to securing decentralized finance protocols. In a press release associated with that work, ZkLink Co-Founder Vince Lang stated: “It is unacceptable that billions of dollars are lost each year due to custody fraud or cross-chain bridge exploits, so we encourage other DeFi protocols to conduct the same test to prove self-custody of user’s funds.”

Bitmain to Launch Filecoin Token Mining MachinesBitmain, the well-known Chinese manufacturer of Bitcoin mining machines, has made a significant announcement that marks its entry into the Filecoin ecosystem.FIL token miningAccording to that announcement made by the company on social media on Friday, the company is set to launch FIL token mining machines, which are expected to have a hash rate of up to 4,300T each and will be available for purchase at $38,888 per unit.Filecoin, created by Protocol Labs, was originally designed as a blockchain-based collaborative digital storage and data redemption solution. This service offers traders an opportunity to earn more through staking with minimal computational energy. Delegated staking allows users to delegate their staking rights to validators or staking pools, enabling them to partake in the rewards generated by these validators.According to a recent report by crypto market intelligence firm Messari, Filecoin’s data storage market continued to grow in Q2, 2023. Active data storage deals grew 64% when compared with the previous quarter. That deal flow resulted in increased revenue from fees, which was up 91%. Further development of the Filecoin protocol resulted in the recent introduction of the Filecoin Virtual Machine (FVM). That runtime environment for smart contracts has enabled new use cases, including liquid staking, decentralized computing, and perpetual storage.Bitmain’s venture into the Filecoin ecosystem not only supports the development of FIL token mining machines but also offers hope for FIL token holders who experienced losses. The FIL unit price peaked at $190 during the 2021 crypto bull market. The company’s involvement has positively influenced Filecoin’s price.Meanwhile Bitmain continues to be a major player in the crypto mining equipment space. 2021 has not been without its blemishes for the company though, as in April the Beijing-based company was fined $3.7 million by the Chinese authorities for a violation of Chinese tax regulations.Bitmain hashrate dominanceEarlier this month, US bitcoin miner TeraWulf purchased 18,500 mining machines from Bitmain, with a view to deploying them at its 43 MW Lake Mariner mining facility in New York State in the US. The deal had a value of $75 million.A recently published report by crypto intelligence firm Coinmetrics outlined that the majority of the Bitcoin hashrate is being processed by Bitmain’s S19 miner model. Three Bitmain miner models are responsible for 76% of the entire Bitcoin network’s hashrate, the report states.
