Korean Financial Authorities to Provide Support for Security Token Market

Amid growing calls for accelerating the growth of the emerging security token (ST) market, the South Korean government is preparing to introduce supportive measures. The security token market is powered by blockchain technology which allows fractional investment in real world assets (RWAs) such as real estate and artwork.

Security tokens are digital assets that represent securities generated through a process called security token offering (STO). These tokens, backed by RWAs, can be traded similarly to traditional securities. Investors can use these tokens to obtain shares, voting rights, interest, or profits.

Support measures for security token Industry

Next month, the Financial Services Commission (FSC) will draw up support measures and policy improvement plans to bolster the nascent security token industry. An FSC representative mentioned that the agency intends to work with the National Assembly to finalize the legislation of security token-related bills by November. Furthermore, the government official said the FSC will actively seek input from industry stakeholders to formulate strategies for enhancing policies designed to promote the growth of the security token market.

To align with the national objective titled “The Establishment of Digital Asset Infrastructure and Regulatory Framework,” the FSC revealed regulatory guidelines for security token issuance and distribution in February. These new guidelines are centered around the establishment of institutions responsible for account management and entities engaged in over-the-counter (OTC) trading. Subsequently, in July, lawmaker Yun Chang-hyun, a member of the National Assembly’s National Policy Committee, proposed a bill to amend the Electronic Securities Act and the Capital Markets Act with the aim of ensuring that these Acts are consistent with the new regulatory guidelines.

 

Security token market’s growth potential

With growing anticipation that the security token market could rival the size of the exchange-traded fund (ETF) stock market, securities firms, banks, and blockchain companies have been eager to carve out a niche for themselves since the start of the year. However, their progress has been hindered by a potentially extended period of higher interest rates in the US and the slow advancement of security token-related legislation. While these organizations tried to explore opportunities through the financial regulatory sandbox, their endeavors proved more or less fruitless. An official from a securities firm voiced concerns over the escalating costs of setting up security token infrastructure, especially with legislative delays.

On this matter, the Korea Financial Investment Association (KOFIA) has emphasized the urgent need to pass security token legislation to clear up regulatory ambiguities. They’ve also called for measures to stimulate market growth, such as relaxing regulations related to token issuance and distribution and increasing investment caps.

At a seminar hosted by the Korea Capital Market Institute, Ahn Hyuk, Head of the Platform Division at Korea Investment and Securities, highlighted that the rigorous review of security registration applications by the Financial Supervisory Service (FSS) might impede the security token market’s growth. Responding to this, Jang Young-shim, Head of the Corporate Disclosure Department at FSS, said that both the FSC and FSS will carefully listen to industry feedback, addressing a range of topics from regulatory relaxation to investor protection.

Alongside DOSI Land, DOSI has also implemented other reward programs such as DOSI Adventure and DOSI Arcade, offering a variety of NFTs to membership owners.As part of its efforts to expand the DOSI ecosystem, LINE NEXT incentivizes FNSA rewards to users actively engaging in DOSI through DOSI Land. The company plans to continue offering various benefits to DOSI users.DOSI’s presenceSince its beta launch, DOSI has attracted 4.6 million membership owners, facilitating over 410,000 transactions and involving 190,000 traders. These figures are as of May 2023. LINE NEXT cites NFT data analysis platform NFT Go’s statistics to state that DOSI is Asia’s largest and the world’s third largest platform in terms of monthly NFT traders. With its mission to establish a global ecosystem for NFTs and Web3, LINE NEXT aims to foster a thriving NFT platform business.The Finschia FoundationIn March of this year, the Finschia Foundation was established in Abu Dhabi, UAE, by Line Tech Plus, a Singaporean-based subsidiary of Line Corporation. This establishment was an effort to expand the corporation’s global Web3 endeavors. Line Corporation is a subsidiary of Z Holdings, jointly owned by South Korea’s Internet search engine provider Naver and Japanese technology investor Softbank Group.The Finschia Foundation operates Line’s open blockchain mainnet Finschia and rebranded its native crypto asset LINK (LN) to FINSCHIA (FNSA) last month. Additionally, the prominent cryptocurrency exchange intends to provide guidance to blockchain projects and generate public interest in the field.Effective communicationFoong also emphasized the importance of effective communication between cryptocurrency companies and government entities. He suggested that clear and consistent crypto regulations would enable international companies to secure large-scale funding, while unrestricted capital inflow would facilitate efficiency and innovation within the industry. US Treasury Sanctions Gaza-Based Crypto OperatorThe Office of Foreign Assets Control (OFAC) of the United States Department of the Treasury has imposed sanctions on a crypto operator allegedly linked to the Palestinian militant group Hamas.The move by OFAC comes as a result of greater scrutiny of terrorist financing following an attack by Hamas on Israel in early October, in which a number of Israelis lost their lives.Photo by Karolina Grabowska on Pexels“Buy Cash Money and Money Transfer Company”The entity targeted by these sanctions is a Gaza-based virtual currency exchange known as the “Buy Cash Money and Money Transfer Company.” It is operated by Khan Yunis, a resident of Gaza. According to the Treasury Department, both the exchange and Khan Yunis are alleged to have ties to Hamas. Ahmed M.M. Alaqad, the owner of the business, has also been named in the sanctions.The primary objective of these sanctions, as stated by the Treasury Department, is to disrupt the sources of revenue for Hamas. The attack on Israel served as a trigger for these actions. Treasury Secretary Janet Yellen emphasized the determination to prevent Hamas from raising funds for further acts of terror and violence against the people of Israel.This includes imposing sanctions and cooperating with international allies and partners to identify, freeze, and seize any assets related to Hamas in their respective jurisdictions. Yellen stated:“The United States is taking swift and decisive action to target Hamas’s financiers and facilitators following its brutal and unconscionable massacre of Israeli civilians, including children.”Crypto sector riskIt’s not the first time that crypto platforms have been implicated where terrorist financing is concerned. Earlier this year it emerged that Bitfinex Turkiye, the Turkish local exchange business of global crypto platform Bitfinex, was alleged to have been used for the purposes of money laundering by Hamas. Additionally, leading crypto platform Binance has found itself facing similar allegations.In the immediate aftermath of the recent attack, Israeli authorities moved to close down accounts they claimed were linked with Hamas on crypto platforms like Binance and elsewhere. The Israelis have continued where they left off in this respect, with a report emerging earlier this week that over one hundred accounts on Binance have been ordered to be shut down, with a further two hundred accounts facing scrutiny.While crypto may not account for a sizable proportion of terrorist financing means, these events open up a point of attack for those who oppose the further roll-out of decentralized money and systems.Fighting illicit finance through sanctionsNotably, the US Treasury has been employing sanctions as a tool to cut off financial support to entities suspected of being involved in terrorism or other illicit activities. In a similar vein, earlier in October, the Treasury announced sanctions against crypto wallets associated with Chinese chemical manufacturers, concurrently with an indictment from the Department of Justice related to the production of the drug fentanyl.Earlier this year, blockchain analytics firm Elliptic indicated that most Chinese suppliers of fentanyl precursors were accepting payments for the illicit material in cryptocurrency.It’s worth mentioning that this move by OFAC not only targets Hamas but also includes other entities allegedly connected to the Buy Cash Money and Money Transfer Company, including an al-Qaeda affiliate and the Islamic State of Iraq and Syria (ISIS).
