HKMA Issues Warning Against Crypto Firm Misrepresentation

The Hong Kong Monetary Authority (HKMA), the central bank for the Chinese autonomous territory, has taken a stand against cryptocurrency businesses that falsely present themselves as “banks” and market their products as “deposits,” issuing a public advisory to raise awareness about the issue.

Banking ordinance violations

In a press release published to its website on Friday, the HKMA said that instances had arisen where crypto firms had labeled themselves as “crypto banks,” “crypto asset banks,” and “digital trading banks.” The regulatory authority underscored that such misrepresentations could be in violation of the Banking Ordinance in Hong Kong.

In addition to adopting misleading bank-related titles, these crypto firms have been advertising “savings plans” as “low risk” with “high return,” potentially misleading the public into believing that these entities are authorized banks in Hong Kong, where they can securely deposit their funds.

The HKMA stressed that only entities such as licensed banks, restricted license banks, and deposit-taking companies, collectively referred to as “authorized institutions” and holding a license granted by the HKMA, are legally permitted to engage in banking or deposit-taking activities in Hong Kong.

Furthermore, funds held on crypto exchanges are not covered by Hong Kong’s Deposit Protection Scheme. “Under the Banking Ordinance, only licensed banks, restricted license banks and deposit-taking companies, which have been granted a license by the HKMA can carry out banking or deposit-taking business in Hong Kong,” the HKMA stated.

 

Misuse of banking terms

Any entity using the term “bank” in its business name or implying that it offers banking services in Hong Kong is committing an offense, according to the central bank. The same rule applies to any entity engaging in deposit-taking activities in Hong Kong or soliciting the public to make deposits.

It’s important to note that crypto firms not officially recognized as banks in Hong Kong are not subject to the oversight of the HKMA.

The HKMA advised the public to exercise caution. In cases of uncertainty regarding an entity claiming to be a bank or soliciting deposits in Hong Kong, individuals are encouraged to consult the register of authorized institutions on the HKMA’s website, and if doubts persist, it suggests that they should contact the authority via its Public Enquiry Service hotline.

According to section 97 of the Banking Ordinance, only a bank or a central bank can use the term “bank” or its derivatives in its business name in Hong Kong without the written consent of the HKMA.

Additionally, sections 11 and 12 of the Banking Ordinance stipulate that only entities possessing a valid banking license or recognized as authorized institutions are permitted to engage in banking or deposit-taking activities in Hong Kong. As per section 92 of the Banking Ordinance, only an authorized institution is authorized to issue advertisements inviting the public to make deposits, with certain exceptions.

The HKMA’s advisory serves as a stern reminder to the crypto industry that regulatory compliance and transparency are essential, particularly when using terms associated with traditional banking, to protect the interests of the public.

Koscom Partners with LG CNS to Develop Joint Security Token Platform

Koscom, the technology subsidiary of the nation’s sole securities exchange operator Korea Exchange, has partnered with LG CNS, an information technology service provider, to launch a joint security token platform, according to a Koscom announcement. Task and tech allianceThe collaboration between Koscom and Korean conglomerate LG Group’s affiliate aims to gain a competitive advantage in the increasingly crowded security token market. On Monday, Koscom signed a memorandum of understanding with LG CNS in Seoul to form a task and technology alliance for security token projects.The partnership will combine Koscom’s expertise in building tech-based capital market infrastructure with LG CNS’s blockchain technology to produce fruitful outcomes. The joint project intends to provide distributed ledgers and a joint platform for the issuance and distribution of security tokens. Securities firms operating their own platforms can also choose to use its distributed ledgers. Koscom’s preparationSince last year, Koscom has been conducting research in security token offering and has formed a working group with eight securities firms that have their own security token teams. The working group has been hosting seminars regularly since the second half of last year, and on April 4, Koscom revealed its project plan to 25 other Korean securities firms. LG CNS’s readinessLG CNS has been conducting research and development of security token technologies since last year and has complied with the Korean regulatory framework. The company manages a consortium blockchain network and has completed the development of key technologies for security token services, such as highly secure wallets.Using its corporate blockchain platform Monachain, LG CNS has achieved success in developing multiple projects, such as a pilot for central bank digital currencies involving NH Bank and Woori Bank and a non-fungible token (NFT) trading system for Bithumb Meta, a subsidiary of the major Korean crypto exchange Bithumb.Meanwhile, Koscom will support security token projects of not only securities companies but also fractional investment firms and banks. Currently, Koscom is in talks with relevant entities about building infrastructure.

Shares in Moon Inc. surge following 1 BTC purchase

Shares in Moon Inc. (formerly HK Asia Holdings Limited), a publicly listed Hong Kong-based firm that acts as an investment holding company while engaged in activities such as wholesale and retail sales of prepaid products such as SIM cards, have surged following the company’s symbolic purchase of one Bitcoin (BTC).Photo by Thought Catalog on Unsplash93% share price increaseThe stock (1723.HK), which is listed on the Hong Kong Stock Exchange (HKEX), closed at HKD 5.50 following Monday’s trading. That represents a 93% increase compared to the closing share price following the previous day’s trading. The share price has settled somewhat following Tuesday’s trading, pulling back 16% to HKD 4.60. However, it jumped again on Feb. 21, closing at HKD 6.48. Bitcoin adoptionIt’s believed that the stock has been influenced by a decision taken by the company to adopt Bitcoin. The firm bought just one Bitcoin. However, the move has led to speculation as to whether Moon Inc. will become the MicroStrategy (now rebranded as “Strategy”) of China.  Michael Saylor’s Strategy has pioneered the use of Bitcoin as a corporate treasury asset. The company has positioned itself as the frontrunner in terms of the corporate adoption of Bitcoin. The company has amassed 471,000 Bitcoin within its reserves. This accounts for 2% of all Bitcoin. With Strategy’s Bitcoin playbook having been well documented, other companies now appear to be following its lead.  In recent weeks, Metaplanet, a Japanese Bitcoin treasury company, has demonstrated that it is pursuing the same strategy, outlining its ambition to build a reserve of 21,000 Bitcoin by 2026. On Feb. 18, it announced a 10-to-1 stock split in an effort to improve liquidity while executing on that overall Bitcoin treasury goal. Metaplanet shares have surged 3,900% over the course of the past 12 months on the back of its Bitcoin treasury pivot. On Feb. 16, Moon Inc. announced the purchase of its first Bitcoin at a unit price of $96,150. In a statement, the company said that the purchase was financed by way of the firm’s “internal resources.” An evolving global financial landscapeThe company’s board noted the increasing popularity of cryptocurrencies in the commercial world, with particular emphasis on the use of Bitcoin as an investment portfolio asset. It believes that Bitcoin acts as a dependable store of value. It added: “The Board believes that this initial investment is symbolic in scale, and marks a significant step toward aligning with the evolving global financial landscape, and would diversify the Group’s investment portfolio and enhance its asset value.” The company’s stock rose significantly last month when details emerged of a 70% stock position in the firm, taken by UTXO Management, in collaboration with Sora Ventures and other investors. Recently appointed board member John Riggins of BTC Inc. said that this recent Bitcoin purchase by Moon Inc. “is more than a transaction.” He stated, “It’s a bold step toward creating a vision for the future of the company.”
