Dubai regulator tightens crypto marketing rules

Dubai's regulator, the Virtual Asset Regulatory Authority (VARA), has been ahead of the curve by comparison with its peers internationally in getting a crypto regulatory framework in place, and now it's moving to tweak those regulations further.

 

In a press release published via ZAWYA on Sept. 26, VARA announced an update to its crypto regulations which specifically deals with marketing. Its addition of “Marketing Regulations for Virtual Assets and Related Activities 2024” applies to virtual asset service providers (VASPs) operating within the Emirate of Dubai. In tandem with the updated regulations, VARA has published a marketing guidance document to assist VASPs in abiding by the regulations, providing detailed instructions and outlining best practices in terms of the application of appropriate marketing activities.

Mandatory disclaimer

One of the new requirements demanded by the regulator is that marketing content related to digital assets should incorporate a disclaimer outlining to investors that there are financial risks associated with digital assets. To that end, from October 1 onwards, VASPs are required to add the following disclaimer, prominently displayed, within product marketing material:

 

“Virtual assets may lose their value in full or in part and are subject to extreme volatility.”

 

In its guidance documentation, VARA has stipulated that any content which contains contradictory messaging or information provided to users in “small print” is not deemed to be acceptable. The rules apply to both licensed entities and any unlicensed entities that attempt to offer a service within the Emirate of Dubai. 

 

Consumer protection

The motivation behind the regulatory update is the protection of consumers through the prevention of the dissemination of misleading information. The regulator wants consumers to be well-informed about crypto products, such that they’re aware of both the risks and opportunities associated with digital assets.

 

VARA has set out a schedule of fines, broken down by category, with fines of up to 10 million United Arab Emirates (UAE) dirhams (AED), around $2.7 million, applying for those who do not comply. Commenting on the updated regulations, VARA CEO Matthew White stated:

 

“Our updated marketing regulations and the newly issued guidance document reflect our commitment to maintaining Dubai’s position as a global leader in digital finance. We believe that by providing clear and actionable guidance, we can help VASPs deliver their services responsibly, while fostering greater trust and transparency in the market."

 

The Dubai regulator isn’t the only one to home in on the marketing approach taken by crypto service providers. Since October 2023, the UK Financial Conduct Authority (FCA) has implemented new rules which specifically deal with the marketing of crypto products and services. Many crypto platforms found the new requirements too arduous to follow. Some withdrew from the market while others did so on a temporary basis while working towards becoming compliant.

 

Within the European Union, the Markets in Crypto Assets (MiCA) regulation came into force in June 2023. Those regulations demand that crypto service providers provide information and conduct marketing activities in a clear, fair and non-misleading manner.

Dubai Regulator Suspends BitOasis’ Crypto LicenseDubai’s pioneering cryptocurrency exchange, BitOasis, has had its operating license suspended by the city’s cryptocurrency regulator for failing to meet key conditions within the required timeframes. The Virtual Assets Regulatory Authority (VARA) took enforcement action against BitOasis and initiated a review of the Dubai-based firm.BitOasis was granted a conditional license on April 12, which allowed it to operate on the condition that it met specific requirements within 30 to 60 days. However, the exchange has failed to fulfill these conditions, leading to the suspension of its license. VARA did not disclose the exact nature of the unmet conditions, but it stated that until they are satisfied, BitOasis’ “License for Institutional and Qualified Retail Investors” will remain non-operational.Photo by iridial on UnsplashFirst MVP broker-dealer license holderBitOasis had received the first “minimum viable product operational license” from VARA, enabling it to offer broker-dealer services to qualified institutional and retail investors in Dubai. This license represents a crucial step towards obtaining a full market product (FMP) license, but as of now, no firm has been issued an FMP license by VARA.To become eligible for the FMP license, BitOasis must fulfill the conditions specified in its current license, as outlined by VARA. The regulatory authority has emphasized its commitment to monitoring the situation for compliance remediation.OPNX reprimandThis recent development follows VARA’s reprimand of Su Zhu and Kyle Davies, the co-founders of the now-defunct crypto hedge fund Three Arrows Capital, in April. The duo had operated and promoted their new OPNX crypto exchange in Dubai without the necessary license, catching VARA’s attention.BitOasis addressed the regulatory concerns in a blog post on Tuesday, affirming its collaboration with VARA to meet the remaining conditions for the Operational MVP License. The exchange clarified that the issue with its license does not impact other services provided, such as broker-dealer services for existing retail users. It also took to Twitter on Tuesday to clarify the situation. The company has suspended new user registrations until further notice, presumably as it works towards meeting VARAs licensing requirements.BitOasis stated: “You can continue to use BitOasis with the assurance that your assets are safe, secure, and held at their full value on our platform, and our team will continue to cooperate with the Virtual Asset Regulatory Authority and fulfill all post-operational license terms, as well as working towards a full market product license.”The firm referred to the “unique challenges” that are associated with licensing and suggested that it is determined to address them and to “be a leader in the virtual assets sector.”The suspension of BitOasis’ license highlights the stringent regulatory environment in Dubai’s cryptocurrency sector. VARA is demonstrating that it remains committed to enforcing compliance and ensuring that crypto exchanges meet the necessary requirements. BitOasis must rectify the issues and meet the conditions of its license to regain its operational status and proceed towards obtaining the coveted full market product license in the future.

In a social media post, the Metis team referred to the decentralized lending market going live on the network as “a new era of Decentralized Finance.”The development is significant for Metis, given that Aave is the third largest project in crypto based on the total value locked (TVL) metric. Within DeFi lending, it’s the biggest project in the sector, holding a TVL of $5.4 billion.One of the keys of Aave’s dominance is its multi-chain strategy. Metis marks the eighth network upon which it has been deployed. The others include Ethereum, Polygon, Arbitrum, Optimism, Fantom, Harmony and Avalanche.Metis technical roadmapWhile there’s a lot of uncertainty as to how various crypto projects will pan out over the longer run, most agree that Ethereum is here to stay. Metis stands a good chance of contributing to that ecosystem over the long term as layer two scaling networks are likely to be part and parcel of the Ethereum environment for some time to come.Last month, the project set out a technical roadmap, detailing what the project has in store, while claiming that in general, 2023 would be a great year for Ethereum. Metis is a layer two network based on Optimistic Rollup architecture. It has grown into the third largest scaling network relative to Ethereum.The project plans to roll out Bedrock, a technical upgrade that will enable improved network security. Furthermore, it plans on bringing about consensus and execution separation. Also in its sights are faster deposit times, which the project claims, will enable better UX.Many DeFi networks are under scrutiny in terms of the centralized elements that they incorporate. Metis plans to make improvements in this regard, with the intention of decentralizing the sequencer pool. The project claims that “Metis Andromeda will be decentralized to the core.”Hybrid rollupsDemonstrating further ambition, Metis is aspiring to bring about hybrid rollups, combining the features of optimistic rollup architecture with zero-knowledge proofs. In a tweet, Head of Marketing and MetisDAO Co-Founder Kevin Li said that “by combining the best traits from both schemes, hybrid rollups will offer the unmatched scalability and EVM-equivalence of optimistic rollups, together with the censorship resistance and fast finality enabled by zero-knowledge proofs. The best of both worlds.”MetisDAO believes it adds value for users of its network through Aave’s offering, enabling them to borrow assets with less collateral via Aave’s High-Efficiency mode. Furthermore, the deployment makes for improved risk management through supply and borrow caps, and siloed borrowing, reducing the risk in the event of market contagion.
