Asian Market Surge for XRP Amid Broader Market Implications

XRP, the cryptocurrency and native token used by real time gross settlement system, Ripple, has seen renewed activity in recent weeks in terms of trading volume. That trading volume appears to be more pronounced in Asian markets such as South Korea.

The XRP token has traded up 22% over the course of the past seven days, with a current unit price of $0.54. Trading volume has surged on South Korean exchanges such as Bithumb UpBit and Korbit where volume spiked 18%, 37% and 50% respectively over the past 24 hours. This trading activity is irregular as ordinarily the trading volume of Bitcoin and ether would account for the vast bulk of trading on the three leading Korean exchanges.

 

Speculative interest

XRP has under-performed in recent years and at the heart of its difficulties has been a multi-year legal battle with the Securities and Exchange Commission (SEC) in the United States. In its complaint, the SEC has claimed that XRP is an unregistered security. Speculation in recent weeks suggests that this highly litigated battle may be drawing to a conclusion. Many commentators have suggested that either a deal will be struck or the court could soon decide to rule on the matter.

During the 2017 bull market, the token reached the heady heights of a $3.40 unit price. That’s a target that the cryptocurrency has never been able to reach ever since. During the last bull market, it rose to around $1.76 for a short time in April 2021. There’s little doubt but the regulatory cloud hanging over it has suppressed the price. Much depends on the outcome of this lawsuit, not just for XRP but for crypto as a whole.

Another notion driving speculative interest is the idea that the Commodity Futures Trading Commission (CFTC) may classify XRP as a commodity. That line of thought is more recent and follows the CFTC classifying a number of cryptocurrencies as commodities in its lawsuit against global crypto exchange Binance. In follow up comments earlier this week, CFTC Chair Roistin Behnam reiterated the claim.

The very fact that the CFTC has made this claim is significant in terms of the case being pursued by the SEC, potentially weakening the SECs case. Lawyers for Ripple have made the court aware of the CFTCs claims.

 

Crypto moving forward

Crypto traders in South Korea have been notorious in the past for pursuing speculative trends within the industry with the Kimchi Premium on Bitcoin back in the day as a stand out example. Whether speculative or not, the outcome for XRP, Ripple and the broader cryptocurrency space relative to the cryptocurrency’s regulatory status will be significant.

A positive result will not just be a fillip for XRP, Ripple and Asian and other crypto traders who have speculated on such an outcome. It will also serve to provide a level of regulatory protection for all other crypto projects within the United States. A negative outcome to the lawsuit will not be ideal for XRP, Ripple and US-based crypto projects. However, Ripple CEO Brad Garlinghouse has said in the past that if innovation is driven overseas, Ripple will focus on developing its product overseas.

In an interview this week Ripple President Monica Long suggested that over and above the lawsuit, crypto innovation is generally being pushed outside of the United States. Long cites Asia as taking the lead on “thoughtful crypto policy”. On that basis, it’s likely that one way or another crypto moves forward and maybe South Korean speculators will be proven right regardless of the outcome of the XRP..

HTX Hacker Returns FundsThe hacker responsible for the nearly 5,000 ETH exploit on the Seychelles-headquartered cryptocurrency exchange HTX (formerly known as Huobi) last month has decided to return the stolen funds.Towards the end of last month, the exchange fell victim to a hack, resulting in a loss estimated at around $8 million. According to on-chain data, the hacker has repatriated the pilfered cryptocurrency, marking a significant development in the aftermath of the cyberattack.Photo by Shubham Dhage on UnsplashHacker rewardedThe returned funds were sent back in two separate transactions, one consisting of approximately 4,000 ETH and the other totaling around 1,000 ETH. HTX advisor and Tron Founder, Justin Sun, took to X (formerly Twitter) to officially confirm the recovery. In his statement, Sun revealed that HTX had not only received all the stolen funds as promised by the hacker but had also extended a gesture of goodwill. HTX rewarded the responsible party with a “white hat bonus” amounting to 250 ETH, equivalent to a substantial $400,000.Sun expressed his satisfaction with the hacker’s decision, stating:“We have confirmed that the hacker has fully returned all funds, as promised, and we have also paid the hacker a white hat bonus of 250 ETH. The hacker made the right choice. We would like to express our gratitude to everyone in the industry for their help.”Hacker advisory messageDuring the return of the funds, the hacker conveyed a message on-chain, shedding light on the reason behind this act of restitution. The message read:“Received your message. White hat bonus to0x1Fc8674A51D6b97C968BE384337519CE7003152B. Your system hot wallet private key leak, you should change system hot wallet address and reduce the system hot wallet rate.”HTX, in response to the hacker’s decision to return the funds and in accordance with its commitment, promptly sent the white hat bonus to the specified address. The exchange also requested the hacker to provide a detailed security vulnerability analysis report to the email address htxsafe@htx-inc.com.This request aims to prevent similar incidents in the future, with assurances that the hacker’s privacy will be safeguarded.Justin Sun had confirmed the original hack in September, at the time reassuring the community that HTX had covered all losses arising from the attack and resolved associated issues satisfactorily.While acknowledging the severity of the hack, Sun pointed out that the stolen amount represented a relatively small fraction of the $3 billion in assets held by HTX’s users. To incentivize the return of the funds, HTX had even offered a reward of 5%, which equated to $400,000.However, Sun also emphasized that if the funds had not been returned within a seven-day window, the company would have been compelled to involve law enforcement authorities.Thankfully, it did not come to that, and the cryptocurrency exchange can now move forward with the confidence that its users’ assets are secure. This incident highlights the importance of cooperation and ethical choices within the crypto community, as well as the potential for resolution even in the face of cyberattacks.

Bhutan Partners With Bitdeer on Crypto Mining FundSingapore-based Bitcoin mining firm Bitdeer has entered into a partnership with the commercial arm of the Royal Government of Bhutan to jointly develop green digital asset mining operations within the Kingdom of Bhutan.Bitdeer issued a press release on Wednesday to announce the partnership. Druk Holdings and Investments (DHI) acts as the commercial arm of the Royal Government of Bhutan. It was formed pursuant to a Royal Charter in 2007 with the mandate of making investments on behalf of Bhutan while optimizing usage of resources.Driving growthAccording to the information provided, the two companies will “launch the partnership through establishing a closed-end fund with an estimated size of up to US$500 million.” The initiative will see a canvas for funding commencing at the end of this month. Bitdeer’s role in the partnership is that of a general partner while DHI will act as a strategic limited partner.Bitdeer’s Chairman, Jihan Wu, expressed his enthusiasm in gaining access to Bhutan’s zero-emissions hydropower resources through the partnership. Wu stated that the fund represents “a pathway to foster global stakeholder networks that are driving growth and innovation in the technology sector in Bhutan.”Once funding has been raised, that capital will be channeled directly into greenfield operations on the ground in Bhutan. Dahal had told a local Bhutanese publication that DHI had been engaged in bitcoin mining on behalf of the Kingdom since bitcoin had a unit price of $5,000. In that interview, Dahal acknowledged that the involvement from the outset of its bitcoin mining activities was part of a broader, long term strategy.Bitdeer’s Asia expansionAlthough Bitdeer is Singapore-based, its operations up until this point have been focused on facilities located in Northern Europe and North America. According to this latest announcement, the bitcoin miner sees this partnership as a “crucial expansion into Asia for Bitdeer.” A shift in geographical focus may be well timed by Bitdeer as it emerged today that President Joe Biden in the United States is considering the imposition of a 30% tax on crypto mining.The bitcoin miner completed a long overdue special purpose acquisition company (SPAC) merger with Blue Safari Group last month. As part of that process, it listed on the Nasdaq. That public listing process has been a baptism of fire for the company as shortly afterwards, the company traded down 30% from the point of its initial listing.A corporate filing made by the company with the Securities and Exchange Commission (SEC) provides more detail with regard to Bitdeer’s plans in Bhutan. “We expect to generate 100 MW out of the 550 MW power supply from Bhutan, where the construction of a mining data center is expected to begin in the second quarter of 2023 and complete in the third quarter of 2023,” the filing states.

Korea’s Virtual Asset User Protection Act to Take Effect in July Next YearThe Virtual Asset User Protection Bill was passed during the South Korean National Assembly’s plenary session last Friday, according to a report by news agency Newsis. The legislation aims to safeguard customer assets, establish regulations against unfair trading practices, and enforce penalties. The act is scheduled to take effect one year after its passage.Photo by KS KYUNG on UnsplashDefinition of virtual assetsUnder the act, a virtual asset is defined as a digital representation of economic value that can be digitally traded or transferred. It’s important to note that central bank digital currencies (CBDCs) are not considered virtual assets. Virtual assets with characteristics of securities will initially fall under the jurisdiction of the Capital Market Act.Roles of Korea’s central bankThe act grants the Bank of Korea (BOK) the authority to request data and information from virtual asset service providers (VASPs). This provision is deemed necessary for the Korean central bank to formulate monetary and financial policies, despite virtual assets not being equivalent to traditional currencies.Responsibilities of VASPsMoreover, VASPs are obligated to segregate users’ virtual assets from their own holdings. VASPs are also required to reserve the same type and quantity of virtual assets entrusted by users and maintain a certain proportion of these assets in a cold wallet, which is an offline storage solution.Unfair trading practices will be regulated in a similar manner as outlined in the Capital Market Act. The act specifically prohibits the use of undisclosed information, price manipulation, fraudulent transactions, and trading of self-issued virtual assets. VASPs are barred from suspending deposits and withdrawals without legitimate reasons. They are also mandated to monitor suspicious transactions and take appropriate measures to safeguard users. Any suspected unfair trading practices must be promptly reported to financial authorities. Violators of these rules may face criminal penalties, liability for damages, and potential class action lawsuits.Powers of financial authoritiesThe act also clarifies the powers of financial authorities in supervising, inspecting, and taking action against virtual asset operators. Unfair trade practices can result in imprisonment for more than one year (up to 10 years for violations related to self-issued virtual assets) or fines ranging from three to five times the illicit gains. Assets acquired through unfair trade practices will be confiscated, or an equivalent value will be charged if confiscation is not feasible.Impact on crypto investigationsThe absence of legislation directly addressing unfair trading practices in the virtual asset market has posed challenges for prosecutors. They had to rely on existing statutes related to fraud, the capital market, and financial investments. Once the new act takes effect, prosecutors will no longer need to determine whether a virtual asset qualifies as a security or not.Regarding this development, a prosecutor told local legal news outlet Law Times that the implementation of the new act will escalate prosecutorial investigations into cryptocurrency incidents.Meanwhile, the individuals behind the crash of Terraform Labs’ stablecoin TerraUSD and its sister coin Luna will not be subject to this act due to the legal principle of nulla poena sine lege, which prevents the retrospective enforcement of criminal laws. Do Kwon, co-founder of Terraform Labs, was recently sentenced to four months in prison by a Montenegrin court for passport forgery after being arrested in March. The other co-founder, Daniel Shin, has been indicted by prosecutors in Korea.
