Korea’s Virtual Asset User Protection Act to Take Effect in July Next Year

The Virtual Asset User Protection Bill was passed during the South Korean National Assembly’s plenary session last Friday, according to a report by news agency Newsis. The legislation aims to safeguard customer assets, establish regulations against unfair trading practices, and enforce penalties. The act is scheduled to take effect one year after its passage.

Definition of virtual assets

Under the act, a virtual asset is defined as a digital representation of economic value that can be digitally traded or transferred. It’s important to note that central bank digital currencies (CBDCs) are not considered virtual assets. Virtual assets with characteristics of securities will initially fall under the jurisdiction of the Capital Market Act.

 

Roles of Korea’s central bank

The act grants the Bank of Korea (BOK) the authority to request data and information from virtual asset service providers (VASPs). This provision is deemed necessary for the Korean central bank to formulate monetary and financial policies, despite virtual assets not being equivalent to traditional currencies.

 

Responsibilities of VASPs

Moreover, VASPs are obligated to segregate users’ virtual assets from their own holdings. VASPs are also required to reserve the same type and quantity of virtual assets entrusted by users and maintain a certain proportion of these assets in a cold wallet, which is an offline storage solution.

Unfair trading practices will be regulated in a similar manner as outlined in the Capital Market Act. The act specifically prohibits the use of undisclosed information, price manipulation, fraudulent transactions, and trading of self-issued virtual assets. VASPs are barred from suspending deposits and withdrawals without legitimate reasons. They are also mandated to monitor suspicious transactions and take appropriate measures to safeguard users. Any suspected unfair trading practices must be promptly reported to financial authorities. Violators of these rules may face criminal penalties, liability for damages, and potential class action lawsuits.

 

Powers of financial authorities

The act also clarifies the powers of financial authorities in supervising, inspecting, and taking action against virtual asset operators. Unfair trade practices can result in imprisonment for more than one year (up to 10 years for violations related to self-issued virtual assets) or fines ranging from three to five times the illicit gains. Assets acquired through unfair trade practices will be confiscated, or an equivalent value will be charged if confiscation is not feasible.

 

Impact on crypto investigations

The absence of legislation directly addressing unfair trading practices in the virtual asset market has posed challenges for prosecutors. They had to rely on existing statutes related to fraud, the capital market, and financial investments. Once the new act takes effect, prosecutors will no longer need to determine whether a virtual asset qualifies as a security or not.

Regarding this development, a prosecutor told local legal news outlet Law Times that the implementation of the new act will escalate prosecutorial investigations into cryptocurrency incidents.

Meanwhile, the individuals behind the crash of Terraform Labs’ stablecoin TerraUSD and its sister coin Luna will not be subject to this act due to the legal principle of nulla poena sine lege, which prevents the retrospective enforcement of criminal laws. Do Kwon, co-founder of Terraform Labs, was recently sentenced to four months in prison by a Montenegrin court for passport forgery after being arrested in March. The other co-founder, Daniel Shin, has been indicted by prosecutors in Korea.

The firm plans on recruiting local employees in its endeavor to conquer the market within the world’s most populous nation.OKX intends to rely on local employees who will spearhead its initiatives in the country. Haider Rafique, Chief Marketing Officer at OKX explained:“We’re trying to identify who’s who in the zoo and what is their contribution. There’s a large developer community. How do we help them? Build a relationship with them.”He believes that adopting a community-centric approach will pave the way for a successful entry into the local market. Rafique emphasized:“We’re going to learn about the community. Ironically India has been very active in working towards the establishment of global regulatory standards relative to crypto while coming in for criticism from its Supreme Court recently for the government’s failure to provide regulatory clarity at home.Cryptocurrencies are used and traded at the investor’s risk in India and do not hold legal tender status for banking purposes. Additionally, a 30% tax is imposed on cryptocurrency transactions in the country.Rafique believes that Indian regulators are gradually distinguishing Web3 from centralized finance (CeFi). He remarked: “They’re more concerned about venues that have fiat on-ramps, which we do but don’t offer it in India.” He expressed a readiness for the company to become a front-runner once India establishes a regulatory framework for cryptocurrencies.It’s interesting to note that while OKX embarks on expanding its footprint within the Indian market, Indian crypto market incumbents have been looking to downsize. Indian cryptocurrency exchanges like CoinSwitch and CoinDCX have faced layoffs amid the current market downturn.Notwithstanding current market conditions, it’s likely that OKX is taking a long-term view and positioning itself for future success in what should be a very important crypto asset marketplace in the future.Ryan Selkis, CEO and Founder of crypto market intelligence firm Messari expressed this view, stating: “I love to see companies like OKX expanding in India. The largest democracy in the world should be a haven for crypto innovation in the years to come.”

Circle forges partnership with Japan’s Coincheck

In a bid to expand the utility of USDC (USD Coin) in Japan, Coincheck, a cryptocurrency trading platform based in Tokyo, has unveiled a strategic collaboration with Circle Internet Financial, the global fintech firm and the issuer of the USDC stablecoin. Broadening USDC accessibilityThe partnership, announced on Feb. 27, signals Coincheck's proactive stance towards broadening accessibility to the USD-pegged coin within Japan's cryptocurrency landscape. He expressed optimism regarding the collaborative efforts between Coincheck and Circle in advancing the adoption of digital assets in the Japanese market. Circle’s ongoing focus on JapanCircle's engagement with Japan is not unprecedented, as the company had previously entered into a memorandum of understanding (MOU) with SBI Holdings, a formidable player in Japan's financial sector. This partnership aimed to spearhead digital currency innovation, streamline cross-border transactions and enhance liquidity in the digital asset market. Last month Circle identified the Asia-Pacific (APAC) region as being ripe for stablecoin adoption. It outlined that it was particularly encouraged by the ongoing development of forward-looking regulatory frameworks in Asian centers like Singapore, Hong Kong and Japan. In a parallel development, Circle recently announced a partnership with Overdare, a joint venture which was originally formed in September between gaming firms Krafton and Naver Z, poised to redefine the landscape of mobile user-generated content (UGC) gaming. This collaboration seeks to empower game content creators by integrating Circle's user-controlled Programmable Wallets, enabling them to seamlessly receive USDC payouts for their creative endeavors. Circle's foray into the creator economy through its collaboration with Overdare demonstrates another strategy that the company is employing to bring about adoption and gain traction in the market, pivoting towards Web3 innovation and its emphasis on development within the APAC region. With USDC boasting a market capitalization of approximately $27 billion and circulating supply exceeding $24 billion, as reported in its December 2023 reserve attestation, Circle's strategic partnerships with Coincheck and Overdare herald the latest efforts to trigger adoption within the Japanese and broader APAC region’s cryptocurrency and gaming spheres.
