Singapore High Court Embraces NFTs for Financial Investigations

A recent decision by the Singapore High Court has seen it embrace non-fungible tokens (NFTs) in financial investigations. Financial investigation firm Intelligent Sanctuary, also known as iSanctuary, has been granted permission to attach NFTs containing legal documents to cold wallets linked to a hacking incident.

This innovative approach, similar to the one used in Italy and the United States to deliver court summonses recently, signals a new departure in the application of NFT technology in the legal and financial world.

Moving towards tokenized legal orders

London-based iSanctuary set out details of the court decision in a blog post published to its website recently. A pivotal moment in this scenario was the court’s issuance of a global freezing order encapsulated within soulbound NFTs, securely linked to the specified wallets. Soulbound NFTs are special types of NFTs which are tied to a user’s account. They cannot be transferred or traded.

Although these NFTs do not halt transactions, they serve as powerful deterrents, notifying counterparties and exchanges about the wallets’ dubious past involvement in a hacking event.

 

Monitoring fund movements

Furthermore, iSanctuary has unveiled an ingenious strategy to actively monitor funds leaving these wallets through the NFTs. This innovative method ensures a permanent and unbreakable connection between the NFTs and the wallets.

iSanctuary recounted on its website that it was employed by a businessperson who had lost $3 million in crypto assets and was able to track the stolen funds successfully. Their method, which combines both on-chain and off-chain evidence, was presented by an iSanctuary senior investigator to the Singapore High Court. This led to the issuance of a worldwide injunction.

iSanctuary’s financial and crypto investigators identified a series of cold wallets holding the proceeds of the crime, and the court approved their use of NFTs for service delivery.

 

Mintable collaboration

iSanctuary accredited Singaporean NFT marketplace Mintable as the creator of the NFTs. As reported by local news media outlet The Straits Times last week, this case revolved around a stolen private key and the alleged involvement of Singapore-based crypto exchanges in laundering the stolen assets. The fraudsters, purportedly from Singapore, are alleged to have orchestrated this saga that spans countries from Singapore to Spain, Ireland, Britain, and other European territories.

Taking to X (formerly Twitter) to comment on the saga, Mintable founder Zach Burks stated:

”Happy to help clean up the crypto space and move the NFT ecosystem into a realm of utility and away from the speculation of jpegs!”

In a subsequent post, Burks highlighted further NFT-related innovation when pointing to a central bank digital currency (CBDC) pilot program led by Mastercard that implicated the use of NFTs to stamp out fraud. Mintable supported that particular use of the technology within that project.

iSanctuary’s founder, Jonathan Benton, emphasized the impact of the recent initiative, calling it a “game changer.” The approach enables swift action, allowing for the identification of illicit asset holders and expediting the issuance of civil or criminal orders, even red flags, within hours if necessary. It also demonstrates that NFTs can be put to good use, above and beyond speculative trading.

Notably, the fund has demonstrated solid performance, surpassing bitcoin's annualized return by 35%. This success has instilled confidence in Metalpha, fostering optimism for the fund's future achievements. NextGen Digital is a Hong Kong-based investment company that aims to provide cryptocurrency and Web3 exposure to institutional clients in the conventional finance realm. Alongside its previous partnership with Metalpha, the firm has invested directly in Web3 startups such as iZumi Finance, a liquidity-as-a-service DeFi protocol. In announcing the Metalpha investment, NextGen founding partner Jason Huang said that the company “is committed to providing secure, compliant cryptocurrency investment opportunities and is always focused on achieving alpha returns.” The company is leveraging its Hong Kong Type 9 license, while aspiring to deliver secure and compliant cryptocurrency investment opportunities. Adrian Wang, president and director of Metalpha Technology Holding, expressed enthusiasm about the partnership, stating: "The launch of the NextGen fund marks the first step for both parties to jointly develop compliant products with generous returns. We look forward to establishing a more solid partnership in the future.” Wang had previously stated that clients of the Next Generation Fund were overseas Chinese institutions. “Some of them are family offices, some of them are public companies,” he stated. On-boarding TradFi investmentPositioned as a notable platform in Asia, NextGen aims to facilitate traditional finance's seamless entry into the realm of cryptocurrencies. This strategic investment by Metalpha underscores the evolving landscape where traditional financial institutions increasingly embrace the potential of digital assets. Metalpha, recognized as one of Asia's leading providers of crypto derivatives solutions, collaborates closely with traditional financial entities, including family offices and crypto mining firms. Holding both Type 4 and Type 9 licenses from the Securities and Futures Commission (SFC) of Hong Kong, Metalpha is authorized to advise on securities and engage in real estate investment scheme management or securities and futures contracts management. In May of last year, Metalpha secured a $5 million investment from leading crypto mining equipment manufacturer, Bitmain. Metalpha counts hybrid crypto exchange GRVT among its portfolio of investments. In September it emerged that it had invested in ParaX, a Web3 super app developed by Parallel Finance. In February 2023, the Litecoin Foundation partnered with Metalpha in an effort to provide environmentally friendly mining techniques to the Litecoin ecosystem.

Audius Achieves Token Listing On India’s CoinSwitchAudius, a decentralized music streaming platform which is attempting to cut intermediaries out of the music business, took a major leap forward in the Asian market on Wednesday, scoring a listing of its native $AUDIO token on Indian crypto exchange, CoinSwitch.Photo by Studio Art Smile on PexelsIn announcing the token going live on the platform CoinSwitch encouraged platform users to “trade $AUDIO today and support independent artists worldwide.” Founded in the United States in 2018 by Stanford University graduates Forrest Browning and Roneil Rumberg, the project launched its $AUDIO token in 2020.The token commenced trading on top tier global crypto exchanges shortly afterwards. In terms of listings on Asian exchanges, $AUDIO can be traded on DigitFinex Global, Bitrue and BingX in Singapore, HitBTC and Hotbit in Hong Kong and Tokocrypto and INDODAX in Indonesia. While it is already listed on WazirX, India’s largest crypto exchange by trading volume, the project will welcome another Indian listing via CoinSwitch given a market that ranks sixth in the world in terms of crypto ownership, with a backdrop of a population of 1.4 billion.Web3 with a Web2 UXAudius has taken a different approach than most other crypto projects. From the outset, its founders have focused on giving the platform the look and feel of a Web2 streaming service. Audius decided to embed its non-custodial wallet Hedgehog into the user login process.The strategy has been to make the UX as customer friendly and intuitive as possible in order to aid user on-boarding. There have been trade-offs in taking this approach and with that, the project advises users to keep only a small amount of the $AUDIO token within the Hedgehog wallet. When Hedgehog was launched in 2019, a project blog post proclaimed that “decentralization doesn’t have to come at the expense of user experience.”TikTok integrationEarlier this year, the Web3 streaming service integrated TikTok, allowing platform users to create accounts simply by linking their TikTok profiles. Additionally, the integration meant that users could share their Audius songs in the TikTok videos they produced.In late January, the $AUDIO token jumped 70% in a matter of hours once it became known that Coinbase planned to list the token on January 26. While a CoinSwitch listing is a significant milestone for the project in the Indian market, naturally it doesn’t compare with the volume that a global exchange listing on Coinbase can bring. At the time of publication, the $AUDIO token was trading at $0.29.For its part, CoinSwitch has experienced many of the ups and downs that this nascent industry could possibly deliver. In August 2022, five properties associated with the crypto exchange were searched by India’s Enforcement Directorate on the grounds of suspected contravention of India’s Foreign Exchange Management Act (FEMA).Founded in 2017 by Ashish Singhal, Govind Soni and Vimal Sagar Tiwari, the firm has attracted investment and backing from Andreessen Horowitz, Coinbase Ventures, Tiger Global Management and Paradigm.
