Korea’s Legislative Research Body Suggests Expanding Blind Trust System to Include Crypto

The National Assembly Research Service (NARS) of South Korea last Friday issued a report emphasizing the need to broaden the scope of the country’s blind trust system for public officials. Currently, this system primarily covers traditional stocks, but the report highlights the necessity of extending its coverage to include cryptocurrencies.

Public Service Ethics Act

Under the existing Public Service Ethics Act, public officials holding a rank of 4 or higher within the finance department of the Ministry of Economy and Finance and the Financial Services Commission are mandated to either divest themselves of stocks linked to their official duties and responsibilities or transfer them into a blind trust if the total value of these stocks exceeds KRW 30 million (about $23,000).

 

Blind trust

A blind trust is a mechanism through which a public official transfers their stock holdings to a trustee. Subsequently, the trustee handles these entrusted stocks by exchanging them for other assets and overseeing their management, administration, and disposition. Importantly, the original owner of the stock, who is the public official, is barred from participating in these aspects of the trust and is also kept uninformed about the trust property’s status or details.

 

Debate over expansion

The current policy confines the blind trust framework exclusively to stocks. Nevertheless, there is an ongoing debate advocating for the inclusion of other assets, such as virtual assets and real estate, within its scope. The rationale behind this argument is that these types of assets can also potentially give rise to conflicts of interest. However, counterarguments have been raised, expressing concerns that extending the blind trust to these assets could excessively limit the property rights of public officials. Consequently, as of now, this broader application has not been implemented.

 

Comparison with the US

The Korean blind trust system was inspired by the United States’ Ethics in Government Act of 1978, which does not limit the types of assets that can be included in a blind trust. In the US, a blind trust can encompass not only stocks but also bonds, mutual funds, virtual assets, and real estate. In light of this, the report recommends the expansion of the blind trust system to encompass virtual assets and real estate. This step is proposed to prevent conflicts of interest among public officials pertaining to a wider array of asset types.

 

Enhancing trustee discretion

Meanwhile, NARS also argued for broadening the trustee’s discretion in trust management to render the system more reasonable. This stems from the concern that the existing uniform property sale approach could lead public servants to incur losses. NARS has proposed potential solutions, such as extending the time limit for property sales or mandating the sale of only a portion of the assets, as viable options to address this issue.

Baumann’s colleague, CMCC Global Managing Partner and Co-Founder Charlie Morris said that “the US has been quite negative from the regulatory perspective and it really seems to us that the US is shooting itself in the foot with a machine gun.”Morris elaborated, stating that the US crypto crackdown is handing a golden opportunity to other world regions to lead on blockchain and crypto. Baumann chimed in to clarify that one third of all blockchain equity deals are currently being done in Asia. He maintains that most of the investment community in the West doesn’t appreciate the extent to which capital is being committed into the space by Asian entities.Morris expanded further: “We see places like Hong Kong having a real opportunity at this point in time to bring those firms and entrepreneurs to the city.”Launching $100M blockchain fundAgainst that backdrop CMCC Global is launching a $100 million fund, where funding will be allocated to blockchain projects. Specifically the duo are targeting crypto and blockchain firms at Series A and Series B funding stages. Baumann believes that in tandem with the fact that there’s a lot of innovation emerging in Asia, “there’s plenty of capital sitting on the sidelines waiting for the right entry valuations to pull the trigger.”While Baumann and Morris are majority stakeholders in CMCC Global, the Winklevoss twins (Cameron and Tyler Winklevoss) also have an equity stake in the business. Founders of the Gemini crypto exchange platform, they are investors alongside Hong Kong based Richard Li, who has a net worth estimated to be in the region of $4.6 billion.VC investment into crypto slowed down considerably since the onset of the most recent crypto winter. However, that activity has still been ongoing, something that is entirely different to the 2018 bear market when investment came to a complete standstill. In April, CMCC partnered with Switzerland-based Syz Group with the objective of establishing a funding vehicle with a minimum $50 million fund earmarked for crypto-centric hedge fund investment.Meanwhile, in speculating on the prospects of bitcoin, the CMCC duo expressed the view that double digit gains are well within reach. Morris envisages a Bitcoin unit price of $40,000 in 2023. From a long term perspective the CMCC co-founder suggested that “I can easily see us breaking all time highs and easily breaking $100,000 for bitcoin.”

Bitmain to Launch Filecoin Token Mining MachinesBitmain, the well-known Chinese manufacturer of Bitcoin mining machines, has made a significant announcement that marks its entry into the Filecoin ecosystem.FIL token miningAccording to that announcement made by the company on social media on Friday, the company is set to launch FIL token mining machines, which are expected to have a hash rate of up to 4,300T each and will be available for purchase at $38,888 per unit.Filecoin, created by Protocol Labs, was originally designed as a blockchain-based collaborative digital storage and data redemption solution. This service offers traders an opportunity to earn more through staking with minimal computational energy. Delegated staking allows users to delegate their staking rights to validators or staking pools, enabling them to partake in the rewards generated by these validators.According to a recent report by crypto market intelligence firm Messari, Filecoin’s data storage market continued to grow in Q2, 2023. Active data storage deals grew 64% when compared with the previous quarter. That deal flow resulted in increased revenue from fees, which was up 91%. Further development of the Filecoin protocol resulted in the recent introduction of the Filecoin Virtual Machine (FVM). That runtime environment for smart contracts has enabled new use cases, including liquid staking, decentralized computing, and perpetual storage.Bitmain’s venture into the Filecoin ecosystem not only supports the development of FIL token mining machines but also offers hope for FIL token holders who experienced losses. The FIL unit price peaked at $190 during the 2021 crypto bull market. The company’s involvement has positively influenced Filecoin’s price.Meanwhile Bitmain continues to be a major player in the crypto mining equipment space. 2021 has not been without its blemishes for the company though, as in April the Beijing-based company was fined $3.7 million by the Chinese authorities for a violation of Chinese tax regulations.Bitmain hashrate dominanceEarlier this month, US bitcoin miner TeraWulf purchased 18,500 mining machines from Bitmain, with a view to deploying them at its 43 MW Lake Mariner mining facility in New York State in the US. The deal had a value of $75 million.A recently published report by crypto intelligence firm Coinmetrics outlined that the majority of the Bitcoin hashrate is being processed by Bitmain’s S19 miner model. Three Bitmain miner models are responsible for 76% of the entire Bitcoin network’s hashrate, the report states.

Korbit Passes Post-Audit for ISMS-P and ISO CertificationsSouth Korean crypto exchange Korbit announced on Wednesday that it has successfully passed a post-audit to maintain its Personal Information and Information Security Management System (ISMS-P) certification and four different International Organization for Standardization (ISO) certifications — ISO 27001, ISO 27017, ISO 27018, and ISO27701.“By maintaining our ISMS-P and ISO certifications this year, we were able to reaffirm the stability and trustworthiness of Korbit’s personal information protection capabilities and security management system,” said Oh Se-jin, CEO of Korbit.Photo by FLY:D on UnsplashRigorous criteriaThe ISMS-P is a security management system jointly operated by the Ministry of Science and ICT and the Personal Information Protection Commission, representing the highest level of security management in Korea. It combines 80 requirements for Information Security Management System (ISMS) certification and 22 requirements for Personal Information Management System (PIMS) certification, totaling 102 requirements that must be met. Once obtained, certification is valid for three years, and annual post-audits are required to maintain its validity.Korbit first obtained ISMS-P certification in September of 2021 and has once again passed this year’s post-audit that was conducted last Wednesday.Meeting international standardsIn addition, the exchange had previously passed post-audits for four ISO certifications related to information protection and personal information management systems earlier in June. This includes ISO 27001 for information security management systems, ISO 27017 for information security controls on cloud services, ISO 27018 for protection of personally identifiable information (PII) in public clouds, and ISO 27701 for privacy information management systems.This achievement demonstrates Korbit’s commitment to reliability and security when operating and managing exchange services.“As a crypto exchange, we will continually focus on strict security management to ensure the protection of customer information and assets,” said CEO Oh.
