The South Korean Financial Services Commission (FSC) on Monday (local time) published a new enforcement decree and supervisory regulations for the Virtual Asset User Protection Act, under which non-fungible tokens (NFTs) and deposit tokens are excluded from the definition of virtual assets. The act serves to protect customer assets, prevent unfair trading practices, and enforce penalties.

“The enforcement decree and supervisory regulations provide detailed standards and methods to safeguard users’ assets and establish stability in the market,” the FSC said.

Defining virtual assets

The agency explained that it decided to exclude NFTs because they are mainly bought and sold for collection purposes, posing low risks to holders and the financial system. However, NFTs that can be used as a means of payment for purchasing certain goods and services are considered virtual assets. On the other hand, deposit tokens — which will be managed by the Bank of Korea’s central bank digital currency network — are regarded as a legitimate form of monetary deposit and are subject to relevant regulations instead of the User Protection Act. Other “electronic certificates of economic value,” such as mobile vouchers and electronic bonds, are also excluded from the definition of virtual assets.

 

Enhancing security and transparency

Following the clarified definition of virtual assets, the updated regulations underline conduct measures that virtual asset service providers (VASPs) must comply with. For example, VASPs must calculate the total value of their customers’ crypto assets every month and store at least 80% in a cold wallet to prevent infringements like hacks — a boost from the current 70 percent. Cold wallets are deemed more secure than hot wallets because they keep crypto keys offline instead of staying connected to the internet.

VASPs are also not allowed to arbitrarily block deposits and withdrawals of user assets without prior notice and a justifiable reason like internal system failure or hacks as well as requests from courts, investigative bodies, the National Tax Service and financial authorities. User deposits must be stored in banks, which can invest them only in safe assets such as government bonds.

The act is set to take effect on July 19 next year after a legislative review scheduled for next month.

Tiger Brokers subsidiary awarded crypto license in Hong Kong

A subsidiary company of Tiger Brokers, a Singapore-based online brokerage firm with nine million users, has been awarded a virtual asset trading license in Hong Kong. The subsidiary, YAX (Hong Kong) Limited, has been added to a list of licensed virtual asset trading providers (VATPs) on the website of the local regulator, the Securities and Futures Commission (SFC). Photo by Simon Zhu on UnsplashSeven platforms licensedBack in August, YAX found itself among a list of 11 VATP applicants that had been provided with feedback with regard to issues that needed to be addressed following inspections carried out by the SFC. Evidently, those issues have been resolved given that the company has now been awarded a trading license. YAX is now just one of nine trading platforms that have obtained licenses in the Chinese autonomous territory. These include OSL and HashKey, who were the first entities to be licensed in Hong Kong. HKVAX followed with approval granted in August 2023. Last October, SFC CEO Julia Leung told local news media that the regulator was dealing with 11 applications and that four approvals were imminent. In December, four additional exchanges, namely HKbitEX, Accumulus, DFX Labs and EX.IO, were awarded licenses. Bixin.com, WhaleFin and Matrixport HK are among the eleven applicants that have yet to receive a license. Alongside YAX, Panthertrade (Hong Kong) Limited was issued a license on Jan. 27, meaning that seven platforms have now been licensed. Panthertrade is a subsidiary company of Chinese mobile internet firm Cheetah Mobile.  Crypto trading and custodyOnce launched, YAX intends to extend crypto trading services alongside crypto custody to its clients. The company’s CEO, Kelvin Liu Kai, has said that as it rolls out its service offering, YAX will look to enhance speed trading, focus on transparency and security relative to the trading process and reduce custodial risks.  Tiger Brokers CEO Wu Tianhua has suggested that the virtual asset sector has grown rapidly on a global basis and with that, he sees “immense potential” for further growth. He added:“Cryptocurrencies are a key future investment trend. The establishment of YAX not only demonstrates our confidence in the potential of the market, but also showcases our firm commitment to creating a transparent and secure trading environment.” Swift licensing processThese latest licensing applicant approvals follow confirmation earlier this month that the SFC had extended access to its swift licensing process to all new VATP applicants. The four applicants approved in December had been the first to be put through the process.  In December, Joseph Chan, Acting Secretary for Financial Services and the Treasury (FSTB), confirmed to Hong Kong’s Legislative Council that in addition to the swift licensing process, a consultative panel for licensed trading platforms will be established in early 2025. It emerged in October 2023 that both YAX and Panthertrade were planning on submitting applications for VATP licensing in Hong Kong. With licensing pending, YAX parent company Tiger Brokers partnered with HashKey Exchange in May 2024, in order to launch a virtual asset trading service.  The service was made available to retail investors through the Tiger Trade platform the following month, enabling the platform’s 800,000 users to trade Bitcoin and Ethereum.

South Korea investigates Worldcoin for its personal data collection

On Thursday, South Korea’s Personal Information Protection Committee (PIPC) launched an investigation into Worldcoin’s personal data collection, processing and potential overseas transfer of sensitive personal data, the PIPC announced today via its official website. This comes after a number of complaints were filed against Worldcoin for its data collection practices.  Sam Altman’s crypto project Worldcoin gathers people’s personal data who signed up to have their irises scanned by “orbs” devices, which are currently installed in about 10 locations in Korea, including Yeouido, Pangyo and Apgujeong. Following the launch of the investigation on Feb. 29, Worldcoin has withdrawn six orbs devices in Korea and stopped accepting new members. It has also suspended the distribution of the Worldcoin token (WLD) to members who have already signed up, media outlet Chosun Biz reported.  Free crypto tokens in exchange for personal data For individuals who have their irises scanned, Worldcoin rewards three WLD tokens every two weeks, which are worth approximately $22.5 (KRW 30,000) at the time of writing. The price of WLD has soared by nearly ten-fold from about KRW 1,300 last year to over KRW 13,000 today, according to the data from the local crypto exchange Bithumb. This price surge followed OpenAI’s launch of a text-to-video AI tool, Sora. The current circulating supply of WLD stands at around 100 million tokens. According to Worldcoin’s white paper, the WLD’s total supply cap will remain fixed at 10 billion tokens during the first 15 years following its launch.  The data collected from the eyeball scanning is shared on the Worldcoin blockchain, which is protected by the zero-knowledge proof technology that prevents the data from being tracked or shared with other applications. The personal data remaining in the orbs devices is deleted.  Ongoing overseas investigation on Worldcoin South Korea is not the only country that is examining Worldcoin’s personal data collection practices. The project’s processing of information has raised concerns in other jurisdictions as well, including the U.K., France, Argentina and Kenya. In the U.S., the issuance of WLD tokens has been banned by the country’s authority.

Canaan’s Record Q2 Revenue Amid Profitability StruggleCanaan, a Singapore-based player in the Bitcoin mining sector, has reported a remarkable surge in its Q2 Bitcoin mining revenues, reaching an all-time high of $15.9 million despite continuing to struggle to achieve profitability.The growth, a 43.3% increase quarter-over-quarter, is attributed to the heightened sale of computing power in comparison to Q1, as indicated by the company’s unaudited second-quarter results, which were released on Tuesday.Photo by Rifath @photoripey on UnsplashRevenues boosted by multiple factorsThis surge in revenues was propelled by a range of factors, including the recovery of Bitcoin’s price, amplified computing power, and increased rewards. Notably, Canaan managed to sell 6.1 million TH/s worth of computing power. This marked 44.2% growth when compared with the previous quarter and an 11.7% surge from the same period last year.Despite this surge, Canaan’s overall financial status continues to exhibit challenges in terms of profitability. The company encountered $30.6 million in mining costs during the second quarter, which significantly contributed to a total net loss of $110.7 million for the same period. This net loss reflects a considerable increase from the $84.4 million reported in Q1 and starkly contrasts with the net profit of $90.1 million achieved in the corresponding period of the previous year.Inventory write-downs and impairment chargesThese losses can be attributed to several factors, including an inventory write-down and impairment of property and equipment. Nangeng Zhang, Canaan’s Chairman and CEO, addressed the complexities the company faces in the current market.He noted: “Admittedly, we are still facing a market that has yet to recover with soft purchasing power on the demand front, generating continued pressure on our sales.” Zhang also acknowledged that the company faced challenges stemming from regulatory changes and contractual breaches from a particular partner.Bitcoin mining difficulty and hash rates also proved to be a challenge for Canaan. The Bitcoin network hashrate currently stands at 326.26M by comparison with 226.91M a year ago. An ever higher hashrate is ordinarily a bullish sign for Bitcoin. However, Canaan has to deal with the higher cost of mining even though the Bitcoin unit price has not responded proportionally to meet that all-time high hashrate.While Canaan’s Q2 performance reflected resilience and expansion into new mining projects in Africa and South America, the company’s financial struggles underscore the ongoing volatility and uncertainty in the cryptocurrency space.In terms of cryptocurrency holdings, Canaan disclosed that it held 1,125 Bitcoin with a total carrying value of $28.8 million as of June 30. This inventory included both company-owned Bitcoin and those received from customer deposits. The company also noted an impairment on its cryptocurrency holdings in Q2, amounting to $2.4 million.Looking ahead, Canaan projected its Q3 total revenues to approximate $30 million, acknowledging the persistently challenging market conditions that are prevalent in the industry. The company remains vigilant about its financial outlook as it strives to navigate through the evolving landscape of the cryptocurrency market.In a recent announcement, Canaan unveiled plans to introduce a “groundbreaking, industry-redefining product that will shape the future of Bitcoin mining.” The debut is scheduled for September 12, coinciding with a gala event that commemorates the company’s 10th anniversary.
